My employer won't recognise churg-strauss as disability under Equality Act and put me on disciplinary because of absences. Any suggestions?

Send us your address by private message and we will send you some information that will convince your employer about your condition ...but please tell us a little about yourself too..when and where diagnosed what treatment you are on at the mo.. age ..how long you have had CSS.

Hi,

I sympathise. When my employer knew of my diagnosis, she "let me go". She was able to do this "legally" as I was within my probation period. Technically speaking I wasn't but I was too ill to fight the decision. :-(

If I were you, I'd wouldn't take this. I'd take them to a tribunal or whatever options are open to you.

Churg Strauss IS a disability! I know, I have it and the government recognise it as such because they give me Disability Living Allowance!

My employer did the same too! i was struck with sinusitis, loss of hearing, ear ache, tooth ache, joint pain, followed a week or two later with coughing blood, vomiting, fever and heaving cough. Doctors said i had flu! flu! when i was hospitalised diagnosed with WG and treated with plasma exchange, Chemo and high doses of steroids. so was in hospital for a month january 2011 when i got out was unable to walk and was bed bound throughout February. but still made sure i sent them my sick certificates right after getting out of hospital to work. oh no not fast enough head office sent a letter dismissing my employment for reasons of breach of probation contract "failure to send in sick certificates on time". don't believe there was anything i could do too ill to fight it then mum had a stroke and my DLA claim was rejected because 6 months after i issued the claim i was no longer having problems with balance. I have had no help i now have no job no money and no life.

Where is the information about this being a disability? I have just been diagnosed and have been off work since march. Work have been ok so far but need all the info can get for when I try to go back. Thanks in advance. Xx

Hi,

Sorry to here about your troubles at work I know how you feel it's not easy, one of the things I did when I went through something similiar was to get untouch with my remotoligist through His secretary he was excellent and wrote me a letter detailing my condition; I communicated directly with my personal officer instead of my line manager which made a differance to.

Hope you get a good conclusion.

Hi I have Wegners and was given a final written warning for having to much time off even though i was under going chemo at the time I work for DWp and apparently although they recognise that I am disabled because of my illness and have made consessions (extra sick leave allowance ) I am back on a disciplinary because I have been unwell again and suffering with chronic fatigue. All they seem to need to do is allow extra breaks and I have been given the option to change my hours. I to receive dla.

Do you have the option of a referral to Occupational Health? If so do that, also make sure you have some input into the referral, I wrote all the circumstances for my referral as my line manager recognised that I would be able to explain it better than her. You can always also get advice from Occupational Health service advice centre, if you have one in your area in Sheffield we have SOHAS sohas.co.uk they were excellent and provided help for me and will often attend hearings etc with you and write to your employer on your behalf.

From what I remember from my occupational health for a condition to be recognised under equality act it must last for more than 12 months and have an impact on your life, this applies even if it is controllled with medication, CSS will definitely fall into this category, if you have asthma as part of your CSS then asthma is also covered, because mine is!
