7 and a half year Long battle to make Balfour Beatty understand my condition T., and they have the cheek to sack me for incapability

I have vented on here before about my employer and my issues over feeling that they discriminate against me me because of of my condition after following their policies and procedures and being monitored for my t absence over 2 years. Followed the procedures to the letter and I even appealed for my job back., with a strong case. That my condition should be classed as a disability due to the symptoms that I feel was backed up by their independent occupational health reports which they chose 2 to ignore.

I do feel that it was a waste of time and there they decided that they wanted me gone so I have decided to fight legally., trying to find legal free representative that specialises in disability employment law has been extremely stressful, especially in in this current climate. The results was the only available advice I could find legally was through Citizens Advice Bureau my employer was contacted by acas and would like to set up early Conciliation but are asking me to figure out a schedule of loss.,??. Feels like David vs Goliath have I bitten off more than I can chew. Will my tinnitus stress levels and my mental health allowed me to have the strength to cope with the fight. Any help or advice on this issue would be greatly appreciated thanks for even take the time to read my post

Ooof that’s a lot you’ve got going on there. I would be looking at a cost/benefit analysis of the situation. For example how much is this costing you emotionally and mentally? How much is it affecting your health?

You have already pointed to how stressful this is for you. Only you can decide if it’s the right thing to do for you. I know you’ll probably be wanting to do it for others as well as yourself but you have to take care of your own wellbeing throughout such a potentially stressful case. Could the BTA help you at all I wonder..

You are right. I have hit alow point I just feel that I can not let it go. I have battled for my condition to be fully understood. Will try bta thanks

Hi,

Wow, I’m so sorry to hear about your situation and I am not surprised about the mental toll it is having on you. It does sound like a lot but I can totally understand in why you are pursuing the case. I agree with Chall11 points made. I think the most pertinent thing is your mental and emotional well-being and if you feel you are able to withstand the effects this case may have on that. And whilst I cannot offer you much useful advice (apologies), but I would like to wish you all the best and that I am rooting for you whatever you decide!
