Most Transplant Surgeons won't use an inferior kidney because they all want the best outcome situation. And while the Surgeon has the last word on that, he is only one wheel on the cart, even an Anesthesiologist can halt a procedure if they feel the Patient and/or Transplant Donor are inferior...The sad truth is the risk of Lawsuits for using a less than par donated kidney is just simply too high
Congress can write legislation and Presidents can sign them , but that really doesn't matter much in the scheme of things, because its still Doctors that get Sued in thus Sue Crazy Society if a less than perfect outcome occurs...
My understanding is that because of the severe shortage of donations they use high risk kidneys all the time. That's why they have that numbering system. One problem is that the allotment system is so messed up that good kidneys sit too long and get trashed when they weren't inferior the day before.
