housing options for the future
You won't be able to rent a house to your child and charge them rent because of housing benefit rules. Any assets the person has over 22k (I think) Social services will make them pay for FULL support.
As long as you have a legal tenancy agreement in place and the lease is on the same basis as you would for any other tenant, it is possible as we have done this. Check with your local authority.
You would need to put the property into a trust, and the trust could lease it to a housing provider for them to rent to your child.
Google mysafehome has some options. But you need to decide how you child is going to supported BY LOCAL AUTHT. That’s the first problem ? is your child going to need 24/7 care does she or he be able to live in small group 2/4 in sup/living house or or support flat on there own,, many more questions that need answers before finding a suitable property took us years after he had left college Find local carers groups for support and knowledge go and look at good support living house run by Mencap and other L/D PROVIDERS don’t look outside your L/Authority area because that is a another ball game funding!!!!!!!
Hope this can get you started. Best of luck don’t give up hope
I would get in touch with Mencap they will be able to advise you re housing, wills trusts etc
hi. We rent a flat to our daughter. Charge a commercial rent and she gets housing benefit. We did start this about 8 years ago but we spoke to the council first and got their assurance that this is ok. The only proviso they had was that we were already landlords ie had at least one other rental she’s recently been unwell physically and been in rehabilitation tge council made adaptations and set up a care worker the same as they would for any home owner /renter
I’d speak to your council to see what they say.
Putting the house in a trust would mean that your child would have to be named as the beneficiary of the trust in order to secure it for their long term future sin which case you couldn’t then charge rent to him/her. To charge your child rent it would have to be a trust for another beneficiary who then benefits from the rental income but of course would then have more say in how the house is used or who it’s rented to. We’ve recently set up a trust for when we’re gone and the flat will go into it but from that point no rent can be charged. Definitely speak to a STEP solicitor before going down this route (we used Renaissance who we found through a MENCAP trust and wills seminar) Not cheap but worth the peace of mind
If you have trusted siblings or other children you may have other options but we don’ t so went down this route.
Good luck and keep strong. x
