Hi, I've been reading that it's fairly straightforward to get a financial deputyship but much harder to get one for welfare. If anyone has succeeded in getting one for welfare, what do you think helped your application?

Hi there. It is indeed the case that personal welfare Deputyship are not awarded as frequently as Finance ones. This is because, in theory, the Mental Capacity Act, puts in place a framework for decisions to be made in a person’s best interest, without such recourse to Deputyship being needed. When Deputyship is awarded for H and W, there are often written into it tight restrictions on the areas of authority that it bestows eg to decisions on where the person lives or the withdrawal of medical treatment etc. It does not give you a blanket authority to say what must happen in a person’s life. When you complete the forms you know your loved one more than they do you talk about all the medical history and explain how your the best person to oversea things as your going to be the only consistent thing I. Their life staff come and go but you will always do everything in their best interest etc etc etc I hope this helps
