if someone is on benefits and they recieve 45thousand. And they spend most of it on purpose to get down to 16 thousand can they claim

If a person ges rid of capital to claim benefits the relevant department can go for deprevation.This means tthey can still assume you have got the money and allocate whatever amount for so many weeks.

I think you would have to be careful. I know when you apply for ESA you have to send 3months of bank statements in and if you have spent a lot of big chunks of money in that time, the DWP may question it. I would recommend phoning the helpline at Ataxia UK who are much better placed to give advice on benefits. The number is 0845 644 0606 or alternatively you could e-mail at [e-mail].
