i tried they even sent a doctor to see me i had my specialist nurse backing me but was not successful so i wish you all the luck if you get turned down try again as im going to as i read this advice on this site before

i have been getting full rate dla motibilty and carers for nearly three years. it took me two attempts to get this, they sent a doctor to me as well. don't give up. when you fill in the forms use your worst days as examples. have another go, good luck.

After waiting many many weeks, phoned DWP today re shanes claim, they have docs, nurses, GP forms back but now want one from the school. As schools are off for easter it could be another 2-3 weeks b4 we finaly get a decession. Been waiting since mid Jan. Still will have to wait that extra bit longer.
I agree thou never give up. I myself claim DLA, but not for asthma.
Good luck and remember go by your worse days and what your limits are then not your average or better days.

I get DLA full rate mobility (but no carers_ at the mo , have just had to reapply so am hoping that i will still get it as things are worse now that 2 yrs ago when i 1st got it.
I think i probably got it more for my mobility probs and hemiplegic migraines than asthma ,i wait nervously for the next outcome.

It is likely that you will get turned down first off as they tend to do that with Asthma based claims. However, appeal - it is a bit long winded but I appealed and once they saw me wheezing away and struggling in on my mobility scooter I was awarded middle rate care and higher rate mobility for an indefinite period.
The appeal panel is usually a doctor, a solicitor and someone with experience of disability rights. My panel was really nice and only took 5 minutes to make a decision.

I did have dla for 4yrs (high mobility, medium personal) but i called them to tell them I feel better and now they've sent me the forms to fill out again. I told them to stop giving me the money, as I don't think I'll get the dla now I'm better, so I hope I don't have to fill out the huge forms again. Do any of you think its worth me filling them out? as my asthma is brittle and I am ok most of the time, and then I have really bad attacks now and again.

I was obviously reasonably fortunate (or not depending on how you look at it!?!) From June til October I got the lower rate care allowance but then from October I was awarded higher rate for both care and mobility. Things for me did start getting worse from August time and I sent in a revised claim in October when I realised that I really wasn't boucing back after each attack. They had a report from my consultant for the first claim. They then asked for a report from my GP when they reassessed it. It did take a long time as I have only just got the notification but together with a chunky back payment which helped! I really think I owe my GP one as he is very understanding and does see me quite often at my worst. He basically said because of the instability of my asthma (which is brittle) and the speed I can go down hill and also the amount I am able to walk without getting breathless and having to stop I should have someone with me the majority of the time. It is definitely worth perservering with though.

sorry to hear you did not get your DLA, I lost mine a few months ago and starting the appeal process.
I would advise everyone to appeal as they seem to be turning down a lot of people now.
the annoying thing is that I have been told it will take 3 months for the appeal to go through then another 6 months if I want to appeal to a doctors panel.

I am still waiting to hear about mine, I called yesterday and was told all reports where in and it was with a decissoin maker which could take 3 weeks. I sent mine off on at 9th March, and I know GP and Cons sent their bits back quickly cos they told me!

I have been getting higher rate mobility for 3 yrs and have just been awarded it for another 3 but for some reason i dont get any care. Im not sure if i should appeal as i do need alot of support because of my asthma 24/7. Any ideas , if so how do i go about appealing ? Can they then cancel my present award?

When you ask for the decision to be relooked at or you go to appeal you can loose and be dropped down. Although common sense should say if you have been at a certain level for several years how can you suddenly not be at that level unless you have improved.
Basically with this benefit it is all judged in what you write on the forms and if you write what they have as their set criteria then you get it if you dont you wont.
I have been to appeal with a specialist solicitor to fight a few years ago .
You can ask for a copy of your file and notes on why you have been turned down which is an excellent guide as to whether then to appeal or ask for the decision to be relooked at.
One thing I would say is if you are asking for the decision to be relooked at the onus is on you to provide any further evidence ie consutlant, GP or OT, Physio reports etc
Sadly it is a lottery and I can say it is not just asthma that goes through this with thsi benefit. Cystic fibrosis people ME/CFS most illnesses, if you go to their individual message boards you will hear the same problems.

michael gets the highest rate for care and mobility and these are both purely asthma and allergy reasons, so it isnt impossible. i made sure that the cons was aware that i was making the claim and both him and the resp nurse helped me fill out the forms and i was given the decision straight off the bat, no appealing so i think it was worth discussing with the people who look after you first. i do contact them with every change in med although usually it is just being added on to his already long list. remember to mention the little things you have to do like rinsing the neb after every use and checking the pollen count before you go out - these are things that most folks dont have to do and they do affect your life. hope you are lucky with your appeals etc
My first claim for DLA ever went in around early march time!
And just had a letter today saying I have been awarded LOWER rate mobility of £16.50 a week till february 2008!
I'm gobsmacked as they said they based it on my form and a letter from consultant ONLY!
I aint had a medical or any fighting and thats gobsmacked me ALOT!

I have friends in Bristol who claim DLA for other things and they have had to fight for theirs I am afraid !!
But with mine it seems to have helped that consultant knew what I was saying on the form and that he backed it over and above it !!
Well given its the several cons I been under over 11 or 12 yrs I aint worked that STOPPED me working full-stop I didnt think he wouldnt back me up !!

I got my appeal date this morning for 27 june
I was just woundering what should i expect and if anyones got any tips that might help.
I am going to phone the office in the morning to find out if i asked new con to write a report saying about his finding with the early lung damage if i could use it in this appael. Might help but not sure if it would be allow owell can only but see in the morning I have tryed today but just kept getting ur call is in a Q. and got work soon so did not want to feel rusted.

I think it is would be a good idea to get a report from your current cons. You can send it in to the DLA but also take a copy to the appeal hearing on the day incase they havent got it on file. It is up to you to provide the evidence for the appeal.
At an appeal there will be panel of three people. The main person is a siolicitor then there is a doctor and someone who is knowledgeable on disabitlity. The person I had was really nice and she was disabled herself so fully understood what it was like to struggle.
They will ask you questions and you will need to answer them best you can . You then leave the room and they will make a decision and most of the time they will call you back in after a short while and tell you the the result. You will then be given a copy of the award notice and its over.
Some panels are very friendly soem of them can be quite official.
It is nothing to worry about and you do the best you can

Thank you for ur replys i will have to get my big freeway neb fixed and take it with me. It die the other day so at the mo i am having to speck nicely to my omron which is also playing up it needs new mesh grrrrrrr comp took 3hrs to get on here so me thinks i will need to sweet talk friend to lead me some money and take a trip to PC world so comp can go to comp hospital. So getting back to DLA the more medical bits i turn up with the more chance of getting a little money. Well for work at the mo i use a large spots backpack so will use that for taking note pack that they sent me.
Right need to neb and sleep the phone the clark up about my new con hopefully it will be allowed then that might help.

Hi all i spoke to costas this evening i asked about a letter to try and help with DLA
It was cons SHO who i saw and have been in regular contact. Well when people give me bleep numbers phone number and say feel free to get in touch, well i don't need second telling hehe.
Well to cut a story story he will talk with con on monday and get back to me. I really do hope they can help. I not asking for a lot just a bit of money each week would help with dairy free food maybe get a cleaner just little things would help.
Might be trying singlar soon hope it helps carm hayfever down reallt not looking follow to the warm weather and grass pollen .
Well got first holiday arranged cornwall for just over a week in June i'm going with a friend and we are staying with her aunt. I could do with the break feeling really tired and just stressed out grrrrr.
K back to topic when peps have been tp appeal what is best go on ur own or that someone with u? I have asked my mum to come but she is getting the gitters about if they asked her stuff andshe could answer them. All help welcomed

I just called the DLA office in Bristol where they acknolwedged that my claim was now over the 12 weeks ""deadline"" the reports from Cons and GP were all received prompty and they had no excuse. They are going to raise a query as to why this is taking so long and someone would call me next week if it was going to be much longer. Hohum

It appears that phoning and nagging has some effect. They called me today for more information about if I needed to go upstairs for the loo or if there was one on the ground floor, as I put that stairs knock me sideways. They said they were in a position to make a decision today, and would be writing to me ASAP as was over the 12 week deadline for thier office.
Also turns out they have not got a report from my cons in Ealing, which is good if I have to appeal cos he was very keen I go for DLA in the first place so at least I will have additional ammo if it come to appeal.

I must be really luck then coz i applied for DLA in March and i got middle rate for care and higher rate for mobility and back pay from oct last year straight away - no questions asked, but my con did say that when she wrote her statement that i NEEDED it as i had no help at home and needed to employ a cleaner and my condition was chronic and long term. I also get extra money for incapacity benefit now as i cant work.

I had lunch with an old work collegue who works for the local MP and apparently it is the Bristol office, they are slow and being the South West and therefore elderly people HQ they get a hgue volumne of stuff more than any other office. The fact they have only contacted GP re confirmation it is good as I have my various cons to call on for additional evidence should I need it. Also the fact they called to get conformation of the stair situation is a good omen according to her, she knows her stuff and deals with all the DLA casework and she is good, she should be, 5 years ago I hired her! She says not to panic if I don't get a good result I just need to call her the MP will raise it as casework too.

it all seems a bit random doesn't it. My award was based only on my form and conformation letter from GP, although cons and asthma nurses were happy to have thier name included and would have supported me.
I worried I had not given enough inforrmation as I tend to down play how bad I am (denial type thing) and bristol are known to swines and this was my first claim too.
All I can advise is be honest and up front don't gloss over things but don't over-paint them too much as I suspect that sets alarm bells ringing. I tried to go for an average day, not a really good one and not a really bad one but somewhere in between.

I was turned down again!!! (boohoo)
It's annoying as i asked to reloook at the claim which they say they have done but never asked either myself or my doc for additional info.
I did get a 'blue badge' disabled car parking badge so they believe i have mobility dificulties but the DLA dept don't.
I'd like to invite them to ITU the next time im on a vent and see if they then believe how disabling this condition is.
Sorry for the rant...feel better now.

Truely, appeal again, and get more info to accompany the appeal. Sadly needing to be vented every now and again does not count it is about daily disability and the help you need to get around. Ask your resp cons, your GP and asthma nurse for support and get them to do a report re your mobilty problems and send if off. Until you have been to judicial review you have not exhuasted all avenues. Also contact your MP and get them to badger on your behalf.
One other thing, the general thought here at rbh is that you should go average-bad not worst day as that raises alarm bells. On my worst day getting out of bed onto the commode almsost kills me (clearly I don't live all my life likke that) on my best day I won't need to neb on the way up and down from the loo, so I went for straight down the middle.

I have just got my third and final DLA appeal, I am going to the panel interview appeal on the 27th July to hopefully state my case in person.
I still dont think I will get anywhere as the DLA has turned very strict now on how to give it to.
my only hope is that they also take into account that my GP is sending me to a consultant about my knees as the x-rays did not show anything so the GP now thinks its probably some sort of cartalidge problem and I will need either a MRI scan or have a small operation where they insert a camera to have a look in the knees.
My asthma constultant has also written a report on me so hopefully I will get a good answer but Im not holding my breath (bad joke)

Hi, am new to Asthma uk, so bear with me!. DLA, what a nightmare!. You have to go through hoops to get an initial assessment, appeal,appeal again, get letters from everyone,have examinations tec. It makes me MAD when you think of the people who do get disability benefits, lie on their applications and get everything, when there isn't really much wrong with them!.The DWP need to totally change their qualifying criteria for severe Asthmatics, a fast track system for both componants of the DLA. I'm very lucky, in that I get both the Care & mobility parts. I get a carer coming in Mon to Fri for half an hour a day, to help with housework. But I was told to reapply for a different level of care award. Yet more paperwork, letters, referals etc. It's going to take 11 weeks to see if I'm eligible!!. So I know how you feel!.
