I have just started the process of getting my 48yr old son into supported living I was told I need deputyship I'm an appointee at the moment I was also told that as he's on pip and esa that will both of those will stop as soon as I sign the tenancy agreement and he will have to apply for UC which will pay his rent etc he may have to top up a bit but the dwp agent I spoke to told me he won't be entitled to pip so what is he supposed to live in?? Is this correct as the SW told me he would still get pip I'm only doing this because of my age and to see him settled while I'm still around 😥

hi. The term “supported living” can be misleading. Whether benefits are lost depends on the type of “supported” living someone gets. When my son went to college he lived in their “care home”. I would not have known it was legally a care home because he lived in a normal house which he shared with others but It was a “ care home” as defined by DWP and so when he lived there he lost his PIP as all his accommodation and living costs were paid for by the college who were paid by the Local authority. When he came home to me he had the PIP paid for the holidays. Now my son lives in his own home on his own in a “supported” living set up. He does not lose his PIP. So the moral of the story is : 1. Find out exactly the legal status and definition of his accommodation and living arrangements. 2. Find out how is benefits are affected by this arrangement 3. Get all advice in writing !! Use mencap disability helpline , social care warriors , bringing us together charity to find out the truth about matters. Do not rely on social workers who probably do not know the benefits system as it is very complicated especially when it involves accommodation. Good luck.

My son lives in supported living with 24/7 care staff and because of this he gets all his PIP. But he has to make a monthly contribution of £416 every 4 week month to social services to cover some of his care costs like most of the residents in his home. I think he wouldnt have to do this if he's health funded which is really difficult to get, plus if my son had been on a section in a ATU he wouldnt have to contribute towards his care which seems really unfair that he has too.

What they might mean is that most òf his PIP will go towards his support costs. My son pays £635 every 4 weeks which is nearly all of his PIP. He is still awarded it and receives it but it goes out as direct debit to the LA. They will come and do an assessment regarding how much they will charge. UC is replacing ESA this is why they are changing him over before he moves. His energy bills, water, food etc will come out of that and whatever is left is his. Hope this helps

He is very sociable and I like the idea of him sharing wuth a couple of lads he's had a PA for many years but he likes to mix with others and obviously we aren't always going to be around I am seeing SW Monday I will put the question of benefits to her thank you for your reply

my 47 year old Autistic/epliletic son moved into a supported living house in May last year, he shares with 2 young ladies, they have a sleeping staff and a waking night staff. Each has an en-suite bedroom. My son has 1-1 , 24-7 support. The other 2 have some 1-1 and some shared support.We have a specialist Landlord who is responsible for the rent and utilities. The rent is paid by HB each tenant pays £100 per month for all utilities. My son pays approx £90 a week to the care provider for use of the company care and his petrol costs . I pay £62 a week for his 3 days a week sessions at a SS day centre. He pays towards baking at the daycentre and his food etc at the house is approx £50 a week. This depends on if he goes out to eat, he has no desire to spend money luckily. As his appointee I receive his DLA and ESA and pay his bills from that. So far it’s working very well.

Thank you for your reply I really a the input on here as this is a minefield it seems I have extra questions for the social worker tomorrow thanks to every on here I need to know exactly how it's goin to affect my son the thing is they say I need to have deputyship so we have two obstacles nobody is clear on what Marc will be left with and I have appointee status with DWP but SS say I need more than that to manage his affairs. I thought the benefits would change over but no they stop and you have to re apply which I'm concerned about too soo will see tomorrow thank you all again

Very frustrating as what you are being told is totally different to what has happened in our case.We are Surrey and as I said I didn’t have to have deputyship, I will now apply, the benefits remained the same and paid into my account and I am still paying out everything he needs.

It’s very difficult when different areas seem to have different rules, surely it should be the same rules throughout the country. Good luck
