That is not a simple yes or no. The baby is at the heart of any decision by those who have an interest.
Being aged sixteen is outside the scope of s31 unless the sixteen year old is married.
Being in foster care MAY also raise problems as well because there may be supervision orders in place that MAY need to be amended before any precise decision could be taken about a live birth regardless of any shared interest of the parties involved. In this instant that would be Social Services, the intended mother and then the Foster Parent in that order.
You would need legal advice from a family lawyer before taking any answer as true.
