Can somebody offer me any advice.I have been on long term sickness due to my asthma since 25 March this year.I have now received a letter from my employer advising that my job will be held open till 9th Feb and if i don't return to work they may terminate my contract.Can they do this? Any advice would be helpful .Thanks

hi Asim. if you are in a union then get them involved from day 1. Usualy OH have to see you to see if your work has made any ajustments to help you in your work place. Next step is to re deploy you if you could cope with another job by same people. If OH say you are not fit to work then termination will start and work out what pay you are owed or paid off.x
This is a very complex area and there are a lot of variables including the size of the organisation you work with.
You need to get legal advice either from a union if yo have one or a local law centre
U need to seek advice. Depending on where u stay and severity of asthma can effect if ur covered by the DDA , this means it may mean ur employer has been discriminant against you. Ur employer has to make reasonable adjustments so you can continue your job. However if they have made adjustments and ur still off sick. Then they are still entitled to end your contract. So it's better to seek advice immediately ..,,,
