If I have shrapnel touching my brain, or just shrapnel in my head from 17 years ago, can I sue for medical neglect as It went unnoticed.

you could try but I bet you don't get very far, I found with my misdiagnosis for 2 1/2 years that all my medical notes went missing as was the case surrounding the death of my partner. if you cannot prove it existed

I was only made aware I had shrapnel in my head two month ago after an MRI scan, so it is still in there.

A lot of the solicitors I have spoke with have said they can't do nothing since the incident happened over 3 years ago. Do you know if that is accurate or not ??

Hi Onceaborderer,

There is a limitation of 3 years for claims like this - but in certain, rare circumstances this can be extended. This tends to be when there was no reasonable way you could have been expected to make a claim within the 3 years - perhaps the effects of brain injury, a lack of diagnosis etc. could make a difference.

It sounds like you may have already done this, but the best way to see if you can claim compensation still is to speak to a number of firms from Headway's list and ask them if they can help. You can search the list at headway.org.uk/legal-advice...

They will at least be able to give you some honest professional advice to help you get a more definitive answer.
