Hi fedupmale.

Sorry to hear you have been diagnosed with this condition.

Have you tried asking you doctors surgery or local hospital if they know of any support groups local to you. I know how important it is to be able to talk over worries and fears with people with the same thing. It may help.

Hi Piggy

I was first diagnosed with this conditionabout 30 years ago, it was only in 2009 that i became unfit for work, and following a succesful apeal againdst ATOS awarding me only 12 points which on appeal went to 18 points.

I had another ATOS interview in October 2012 where i was considered fit for work, despite having letters from my consultant for 2009 and the latest one in August 2012 , which was not mention on the report from ATOS , ive had to appeal against their report.

Two weeks ago my money stopped being paid into the bank, when i phoned Job centre plus they told me under the new rules No money would be paid unless i produced a doctors certificate.even though my appeal was dated early December 2012.

Their is nothing on the DWP web site and even CAB didnt know of this rule change

Does anyone else had this recent and unannounced descion !

Regards

Steve

Hello Steve, please be assured that we are looking into this for you and trying to find some info to help you. From what I can see initially, your payments should only stop if medical verification has been requested from you via your GP but not received. This is a reason for your payments to stop. Other than that I cannot understand why your payments would suddenly stop, did they stop without explanation?! Did you attend all the arranged meetings if there were any because if not, this could be another reason for payments to stop?

There are big changes coming in regarding benefits from April 2013, but I am unaware at this stage if the DWP have started tweaking the system yet. From this time benefit claimants won't have an automatic right to appeal, they will have to request that the DWP reconsider their decision first. This period before a decision is reconsidered can be indefinite, there is no set period. If benefits are stopped during this period (the DWP are non-committal about this at present), "alternative" benefit may be paid but it is uncertain exactly what this means at this stage and whether it is true or not.

I would suspect that your payments being stopped is not related to impending changes to the current system.

I would personally suggest that you contact the DWP and ask them directly why your payments have stopped, hopefully there is a reasonable explanation so that the matter can be resolved and your payments recommenced, According to the DWP website the only imminent rule changes will commence in April 2013.

I apologise for this being a bit sketchy, but this is the only information available at present, only the DWP will be able to explain your situation at present. Please call them and let us know how you get on. Once you have this information, depending on what they tell you, then would perhaps be a good time to re-visit the CAB for their advice. Hope that makes sense.

We do care about you and are concerned for you too. We will continue to try to help and support you as much as we possibly can.

Hi Lib

I,m very grateful to you !

When i found out that my payment had not been paid into my account, my intial reaction was to phone Jobcentre plus in Belfast , it was them that told me that i have to supply a doctors certificate before payments will be resumed.

I had complied with DWP filling in their appeal form in December, and also supplying 2 a4 sheets explaining why ATOS ruling was wrong also i supplied copies of the cardioligist letters stating i was unfit to worki had a letter confirming in Early January that they would be considering my appeal.

The morning i found and phoned Belfast was the first time i had been told about this doctors certificate.

I will phone DWP tomorrow and let you know the outcome.

Kind regards

Steve

Hi Lib

I phoned DWP this morning, they passed me onto the Benefits help line who then said they hold no personal information ,and suggested i phone another number, which i duly did, they said i had to phone Job centre plus in Belfast, i tried to explain, that i had already phoned Belfast and that i wanted to speak to DWP , they were not helpful at all,

All this hassle is causing palpitations , it seems an never ending circle

there is nothing about Doctors certificates being required on appeal and to date have had no paperwork from job centre plus or from DWP asking for this certificate.

Kind regards

Steve

Hi Steve, so sorry you are going through all of this. I don't understand how they can't explain simply about needing a Doctor's Certificate and why. I assumed they purely required further evidence, did they not say this?! Did anyone actually tell you why this was needed or even mention this?

Did they suggest where you go from here?

I am trawling through all the sites I can find trying to come up with something for you. Keep in touch my friend, we are all here to try to help you.

Hi Libs

All i can get out of Jobcentre plus is that a doctors certificate is required, they still wont say why this is a requirement, i had already submitted letters to athos which were not mentioned in their report , so after finding out that my money had been stopped i sent another copy of both the original 2009 letter from the Cardioligist at Northwick park Hospital , this was accepted at Watford Court in December 2009 and a second letter dated August 2012 saying from the consultant that my condition had not changed, i was unfit for work still.

I would have thought a consultants letter was far better than a doctors certificate, i will of course keep you informed.

On Thursday i attend a Patient association meeting at my local surgery , where after the meeting i hope i can chat with a doctor.

It seems that if we all had to keep going to the doctors for these cerificates then the doctors workload will increase, which to me is clogging up an already stretched service.

Kind regards

Steve

I completely agree Steve! I hope you can manage to speak to your GP, I personally think this is the best thing to do at this point. I do feel for you, keep fighting, it all seems very unfair and unnecessary to me.

Please let me know how you get on with your GP. Private message me if it's easier. I will do all I possibly can to help and support you through this.

Take care Steve.

Dear Libby

I saw my doctor who could only give me a light duties note for 2 months although i did explain that i hadnt worked since 2009

.I also found on Facebook a post ATOS is it Fair , i sent several letters to their customer relations department, and after several letters have asked to see my appeal papers that they said that they hadnt received.

They have promised to look into my complaints.

In the meantime i spent a considerable time on the phone yesterdaymorning to DWP who have now paid me my arrears, but what annoyed me is that they had this letter from my doctor for over a week and no body contacted me ..

I also stated to Atos that when i see my consultant any deteriation of my health i will be blaming Atos

I will keep you informed

Kindest regards

Steve

Thanks Libs xxl

No problem at all Piggie, always here and will do my best to help where I can. Thanks for the heads up! :) xxxx

Steve, amongst the info I have found so far this morning, there is some info on the Parliamentary and Health Service Ombudsman site that highlights a case where a Medical Certificate was requested by JobCentre Plus because they apparently didn't think the medical evidence provided for this particular person's benefit claim was sufficient?! This person's benefit payments were also stopped during this time. The reason given to this person after he filed a complaint against the JobCentre Plus was that they "did not consider the documents to be suitable medical evidence".

I can only assume similar reasons regarding your benefit claim apply. What confuses me is that they aren't saying what the reason/s is/are for you having to provide a Medical Certificate.

The benefit was Income Support and of course the illness is different, but the principle is the same, here is the link to the article I am talking about because the way this person's case was conducted is very similar to your own and it mentions Belfast etc.

Here is the link to this article for your interest, so you can see you aren't alone, this seems to be a fairly common problem -

ombudsman.org.uk/improving-...

(Please bear in mind we can't discuss politics here to keep in accordance with our Guidelines, and that this is purely an example.)

Not sure this info helps, but it gives a reason for requesting the Medical Certificate etc.

Bless you Steve, I am still delving for more info! :)

Hi, I had the same thing happen to me. I failed the ATOS medical and was luckily phoned by a lovely lady at the DWP to be told that before I got the letter in the post.

It was this lady who told me to send in doctors certicates as I had failed the medical any information I had given them before the medical no longer counted as I had been found fit on that day, so I needed a new doctor certificate to say that I am now ill if that makes sense, and I should also appeal but to remember I would have to keep sending in sick notes till the appeal had been heard

My GP went mad ,and did a new certificate for three months.

Hope this explains why you need new doctors certificate ,

Hope you start getting you money soon

Best wishes
