Legal actions for Fibro

Does anyone know if anyone has ever sued a company for having been affected by Fibro caused by a very stressful job? Where can I find some information?

Hi Izabel

You could look for law cases by googling key words along with the type of job you were in. Ideally you need to find a case where someone has been in the same job as you and has sued successfully. Could take a lot of time or you could be lucky and find something easily. Alternatively you could simply ring a few local solicitors to you and ask if anyone would give you half an hour for free for you to find out if they would be prepared to take on your case. Hi Izabel, I was going to say that, so great minds think alike Nicki! Alternatively if you are able to, you could visit the CAB (Citizen's Advice Bureau) who could give you advice regarding your query. They would also be able to advise on tribunals for unfair dismissal or discrimation issues which have arisen in the past with people suffering from Fibromyalgia in their workplace.

Hi Izabel,

I can tell you from experience that it is a very long and tedious process and almost impossible to prove. Especially if you have any other condition.

I sued my old employer, primarily for an injury at work involving my shoulder and neck, then secondarily for the injury being the trauma that started my Fibro.

The case dragged on for two and a half years, I had to see three different Consultants for each side and then at the end although I received a settlement for the injury that was twenty times their original offer, the Barrister on my side said they couldn't proceed with the Fibro part of the claim because their wasn't more than 51% chance of winning.

Then you must consider who is going to Finance the claim and the court costs for the other side if you don't win.

I approached a no win no fee company first and they advised me that if I had Legal Expenses cover on any insurance policy they were not allowed to take the case. I did, with my contents policy and that was how mine went ahead. Costs were awarded against the other side.

My advice is check your insurance policies and if you have phone them and ask their advice. If you haven't, phone won of the no win no fee companies and ask them.

Whatever, do not go ahead with anyone who wants you to put your hands in your pocket for any up front fee, or wants you to take out a loan or insurance policy to cover any costs.
