Rejected mandatory reconsideration

Afternoon all I've just received my mandatory reconsideration rejection letter for pip.

Scored zero on everything

Since having my assessment on the 12/10 I sent in my mandatory reconsideration on the 23/10 and stated to them that since my assessment I'd been diagnosed with having emphysema and now have an inhaler. On the bottom of the mandatory reconsideration letter it states if you have new conditions or deterioration in your diagnosed conditions since your assessment they can't be considered and need to submit a new claim.

I wanted to ask anyone should I appeal on this claim or should I start all over again?

Any advice greatly appreciated

Sorry to hear that you are going through this stress. I would suggest contacting our benefits team, who can advise on whether you can put in a change of circumstances rather than having to start again

I would appeal. Surely you had the same symptoms at the time of your assessment and submitting your Mandatory Reconsideration? If they were only 11 days apart? PIP is about how your symptoms affect you, not what conditions you have. Unless your symptoms dramatically got worse in those 11 days then appeal your current claim.

That’s correct what the DWP wrote. You will have to do a change of circumstances application. What was your PIP award? When doing a mandatory reconsideration appeal you need to have your assessment report to comment on the descriptors you are contesting. The assessment report is available a week after your assessment and once you have read it if you want or feel you need to submit an mandatory reconsideration application you have 6 weeks or more before receiving the PIP award notification letter. You can only lodge an mandatory reconsideration request once you have received the official PIP award notification letter.

If you put in for a 'change of circumstances,' this would be exactly like a new claim. You'd have to complete a new claim pack, have another assessment, etc.

As mentioned above, you already had the symptoms with this claim, so a 'change of circumstances' is unnecessary, & it's also faster to continue with now appealing to a tribunal; you can do this online should you wish.
