Kevin (and anyone else!) would appreciate your info on whether OTHER CCGs are encouraging CHC claimants to ask for new "retrospective" considerations of CHC claims when the reality is that they haven't completed the processing of the first one (made several years ago)?

I've documentary proof the CHC team were sent the CHC assessor's papers saying Mum had "passed" the CHC Checklist and a full assessment was needed.

I'd also be interested in any advice you can give on which parts of NHS England organisation intervene when a CCG is not compliant with national procedures and performance standards. This particular CCG is already subject to an NHS required improvement plan and has been required to thoroughly audit its CHC practices. My experience with them suggests non-compliance with those demands too.

I've looked at your old posts. You eally have been through the mill!

Simply put it appears that many CCG's have resorted to unlawful practice in order to stem the flow of funds.

It is not unusual for the assessments to be sub par and for the scoring being derisorily low.

Next it is not uncommon for the assessment for assessments to be very late or not happen at all. I seem to remember that the DST should take place within 28 days of the Checklist being completed.

As for retrospective assessments. They get themselves into this position because they didn't do the job properly the first time around. If a substantial amount of time has gone by then they need to re-assess to see what the current needs are. Remember the DST is also about developing a care plan which should be up to date.

Following a new DST they should back date funding.

However the system is in such chaos in most CCG’s...

A complaints letter is a good start. All complaints are required to be placed on file for the inspectorate to see and they always look. In my days in the NHS avoiding written complaints was seen as very important. Now they appear so desperate they seem not to blink and mostly ignore them.

If I were to want to put a complaint in, if the team were not responsive I would write the Chair of the CCG. They most often don’t know the detail of what is being done and a message from to the CHC Team manager is most powerful.

Are you aware of Beacon NHS advocacy? It is an arms length advocacy service and they can be very good.

They used to give an hour free advice over the telephone which could be used over a number of shorter calls. They would be the best people to advise you on your next step.

I hope you shake the coconut out of the tree. It took a lot of shaking before we got anywhere.

Thanks again. It makes me feel a bit better knowing there's a sympathetic ear listening.

I've gone through the formal complaints process (to no avail), including writing to the Chief Officer and to the more junior staff. What I haven't done, though, is to write to the Chair of the CCG - I'll try that.

One of my irritations is that when I write to the CHC team and Chief Executive, they don't reply to the points put, they don't reply at all (literally often) or repeat the message that they want me to follow a procedure which I've already explained to them is unlawful and impractical. My relative is dead now - she isn't available to be "assessed" and the records of her care are largely missing.

I know it's always possible to involve the Ombudsman but fear he / she is incapable of doing the "digging" that's really needed to nail the CCG's misbehaviour. I really see my best bet as getting NHS England to do another investigation of the CCG. It's going to be more than usually challenging to organise, though. The usual route is to involve NHS England at the review panel stage; not possible for us as we need the incomplete first assessment to be completed BEFORE we've got a case to take to panel.

I am so sorry your relative has passed.

I really do understand your justifiable anger. Yo were clearly failed by a crumbling system.

Don't write the Parliamentary Ombudsman off just yet. In a recent conversation I had with a specialist Adult Care solicitor he told me that Social Services are truly frightened at the involvement of the Social Care Ombudsman and that they do dig down properly.

The info helps in several ways and I'm grateful you sent it.

Compass has obviously encountered the kinds of obstruction, evasion, downright misinformation and aggression we've experienced … and they've been able to find ways of getting past them. It gives me hope I might too. Also I'll contact them ASAP and ask whether they're prepared to give a few quick tips over the 'phone on how I can best deal with this particular CCG.
