Hi all,

I received the reply from the care home that caused dad's 11 week hospital stay today.

Just wanted to ask opinions on it please. They've admitted they didn't formulate an adequate care plan, admitted they didn't monitor fluids in and out, despite being asked specifically to do so by my dad's GP, admitted they failed to recognise his distended stomach (fecal impaction and urine retention)...they've said 'thank you' for pointing all of this out, as there are clearly areas they can improve on, including recognising sepsis. They've offered to refund the whole £1890 cost, and then gone to say "please note this does not indicate any admission of liability". They've spelt my dad's name incorrectly, and not even apologised for the extreme pain, distress and lack of dignity they caused to my dad. I don't know what to think. I asked them to a) apologise to my dad b) assure me that this wouldn't happen to anyone with a similar condition and no voice again and c) refund all monies paid. The apology is kind of more important than the refund right now....do I take it further? They've said they'll be informing the CCQ - is there anything I should be doing please?

Dunno if you've done this but I'd report them to cqc?! What a bunch of bar stewards they are! Disgraceful x

Yes, of course there is. Make sure that they have informed CCQ and include your own version of their shoddy care for your Dad.

Definitely need reporting, that sort of care is just not acceptable. Sounds as if they know they are guilty of negligence and are offering you a refund to keep you quiet. Disgraceful is one of the adjectives that spring to mind along with many unprintable ones too. I hope your dad gets compensation for such shoddy care.

It's late so please pardon my brevity.

What has happened sounds awful!

Most definitely you should send a copy of your complaint and their response the the CQC.

You cannot rely on them reporting it to the CQC and if the CQC are informed they will inspect, investigate and ensure that practices are in place to prevent a recurrence. By reporting it you will be taking a large step in ensuring that other patients are protected in the future.

Its unusual for a Home or any other body to say they will be reporting it. So much so it is as if asking you not to do so. Hmm...

Following that you have two choices. First to accept their recompense and walk away or, to pass it by a solicitor. Their words saying they are not admitting liability are probably meaningless (another fog?) as their offer of recompense completely undermines that assertion. I am not a solicitor, but I would put money on it.

Solicitors love to get a good case going which can be expensive. However having a one off meeting to discus it with Solicitor is inexpensive. You may well find a Solicitor who gives you the first thirty minute free of charge.

I am astonished they have oferred a refund. The case against them must be compelling.

PS Do not sign anything excusing them from liability. They have offered to pay not bought their liability back.

Oh my god, how bad is that, us careers can pick up on a urine infection, constipation etc ...... they are suppose to be looking after sick people and they cant pick that up. Disgraceful. Yvonne xx.

Sarah I agree with what has been said. Please note what Kevin has said. I don't believe for a minute they will report themselves to the CQC. However, you should as Kevin said send a copy of their letter to the CQC, along with your own views on what happened.

Go to a solicitor too as this is the worst case of neglect I have heard of.

Is your Dad home now? I hope so, poor man! You can give him an extra hug tomorrow from all of us.

Their attitude beggars belief. How can they admit such disgraceful behaviour. Yes they should be reported most definitely. The word compensation says ' cover up '. This home couldn't organise a booze in a brewery let alone be responsible for sick people. I admire your courage.....come out fighting. Take care. Jx

Don't accept any money etc because as soon as you do your allowing them to get away with it. They are basically paying you off to keep you quiet and by saying they are no way admitting liability it will make it hard for you to take any further action..... because you are agreeing that you think they are not really at fault but they was good enough to reimburse you.... not compensate you for there wrong doing.

Report it to cqc and also go and see a solicitor and they will best advise you as to what your next step should be.

Ask the care home for his care notes and care plan. Don't be fobbed off with there sorry we can't release them they can and should. The solicitor will look over them and will be able to decide if there is a safe guarding issue with the home. Get the sociol worker on side they carry a lot of weight in these situations. Oh dear. Your poor father. The pain he must have been in. How could they not have seen this. Go after them. They shouldn't be allowed to treat another human being like this. I can't think of a word to describe what went on. God bless in your fight for your father's rights.

Hi

When i have complained to our local trust when rog had sepsis twice through neglect i write it as a report, so for example - grade 1 pressure area noted ,13 hrs to get appropriate bed.

What is the guideline in place and was it followed following skjn damage

Who was responsible for monitoring skin

Was documentation complete and who was responsible for obtaining bed.

What training had been completed by staff on duty

This makes them answer in more detail. You always have the Nursing and Midwifery Council to lodge a compaint against practitioners very useful.

Sorry to drone on but after 40 years in nursing i am becoming increasingly ashamed of my profession, rog has only ever been harmed when in hospital or his one stay in a nursing for respite.

I myself am in a very good care home, the care plans wrote each month involve the client and at the clients, request can be read by them or the relatives who have placed them given time to activate request, at times I have asked to read my own and when handed back it is a list of things I disagree with but the nursing staff take them onboard and correct each care plan.

by all means, take it to the CQC more so if your father is safe

I agree with the others, definitely complain. What they allowed to happen to your dad through their neglect is totally shameful. Good luck xx

Thank you all for your thoughts. I've now spoken with the CQC, the adult safe guarding team, got a memo to call the ombudsman, and am waiting for a return call from a solicitor, to see if there's a case to go forwards. When I think of how the nursing staff's actions have affected my dad's quality of remaining life, I could cry. Having given it more thought, I can't let it go, and will take it as far as I can. Thanks for helping me to reach that decision. Now I just gotta find the energy.....!
