Hello my son 4 months an im due to go back work in 2 months .im not going to but have been getting mat allowance from the gov not work will i have to pay this back?

Nope if you just get the statutory govt pay then no you don't pay it back. You are also entitled to holiday pay for holiday that you will have accrued whilst on mat leave. I was in the same boat and had no problems.

Brill thanku.doesv that include if u get another job but start when ur mat leave finishes.do u still receive mat allowance.this is for a friend!

does this mean if you get maternity leave pay from work, paid by work, and you decide not to go back then you have to pay it back? sounds unreal?

U havnt got pay back smp but if u get cmp as extra from ur workthats what you have to pay back.luckly most places only pay smp so u havnt got pay it back

Every company is different as far as I understand, but the maternity pay paid by your employer needs to be paid back if you don't return to work at all. I think that's the same rule all around. And then every employer has a different rule about how long you have to go back for. With me it was 13 weeks. As long as I'd return for 13 weeks I didn't have to pay it back.

I'm pretty sure that you don't have to pay back statutory maternity pay, even if it is paid by your work and they have to pay you for your accrued hols. That's why loads of people don't categorically say they aren't going back until they have had all that. Have a look at the you gov website.

Definitely don't ever have to pay back Maternity Allowance. Your friend can start her new job whenever she likes. If she starts before her Maternity Allowance period is over, then they will simply end the entitlement to Maternity Allowance as of the day she goes back to work. And your friend is still entitled to any annual leave accrued up until the official end of her employment with current employer. Hope this helps.

As a side note, you don't ever have to pay back a Statutory Maternity Pay either. Only if you get additional maternity pay or from your employer, and then you decide not yo return to that employer, then they have the right to ask you to pay that additional pay.
