Legal action for mental health services experience - has anyone done this ?

Hi there. I am strongly contemplating suing for mental health clinical negligence, following a few years of appalling mental health services experiences resulting in a recent suicide attempt and having to leave half way through medical school due to lack of support. But I have no idea where to begin to look for advice on this. I’m not sure how common it is to seek legal action when it’s mental health related. You hear it for physical health experiences, but not mental health...

It unfortunately seems incredibly common that mental health services let people down these days for a variety of reasons, be it lack of staffing, lack of resources etc. But at what point do you draw the line and say my mental health is now considerably worse because you failed to identify the issue and help me sooner when it was in an earlier preventable state? I have a long list of specific encounters which I deem especially complaint-worthy, but I don’t want to get into that on here - I will end up writing an essay.

If anybody has any experience with this and could offer me any advice or better still recommend a mental health clinical negligence solicitor to me, I would be extremely grateful.

I haven’t any experience of this but I would be interested to know what you find out.

I have told the mental health team treating my husband that their care is on the verge of negligence. I honestly think that you pretty much have to have a rope around your neck before they actually take you seriously.

Before you embark on Litigation take advice from a Solicitor who is used to dealing with the NHS. It may also be a good idea to try and get an appointment with the Citizens Advice (CAB) They may be able to give advice and explain the best cause of action

You also need to understand the costs involved in this type of Action can be extremely expensive and you need to be positive you are going to win.

I would imagine when the dust settles because of now ! there will be also an increase in Court Actions in the future ?????. You need a good Lawyer that knows when to fold or advise you on cost and how much this will cost.

The Health Service, like most Services is on the very edge at this time and the Services mental health use are having problems, it seems rationed to a greater extent, not helped by Lockdown you need to understand that. Litigation can and possibly will take several years to go through the Courts, hence your costs. Look for Solicitors on NO WIN NO FEE, to protect your finances

I feel exactly the same the mental health team doesn’t help me at all, no one listens to you. I appreciate that they are really busy but that’s no excuse when people’s live are at stake.

You are not alone my Wife has had three correspondences two letters and an email for her to have Her injection, Covid. The Government put back the 60-65 age group and went ahead with the 18-59 with health concerns and because we are in the North they have having to deal with time sensitive second doses.Over 1000 of the 18-59 and the other clinic stowed out as well. Now the are finishing the 60-65 four hundred Patients This group needs to be seen by mid April. This shows how the system is working to the limit Especially when we take Hospitals and general surgery into consideration. We also need to understand at this time Second injections are time sensitive to twelve weeks. After they deal with the remaining sixties. They then need to return to the 50-59 year old patients to give them first injections.

Scotland seems to be making this time around five weeks, they say the longer the better, twelve weeks. We are in the Hands of the Gods no matter what conditions we may have. I seem to understand it will take at least twelve months or longer for the NHS to get back to normal

Hello, Things are really tough, have they explained Mindfulness to you so you can relax. You should have been introduced to ways to control your problems , Have you been instructed on ways to help yourself ?? Did you discuss and talk out your concerns. I suffer Chronic Pain and I was taken into Pain Clinic so I was able to control my own pains etc. I was introduced to Relaxation Techniques like Mindfulness, this technique does work quite well
