Power of Attorney question

I am working with someone (Hannah) who has a sister with learning disabilities (Lucy). A third sister has Power of Attorney over the sister with learning disabilities. Hannah has been blocked all access to see or hear about how Lucy is and I am wondering how to help with this situation or if there is anything I can do.

Perhaps adult social care in your area will be able to help you. Explain the situation to them and see what they say. If Lucy wants to see Hannah and is being prevented from doing so that is possibly a deprivation of liberty issue and it possibly is against her best interests that family are not involved. Even if Hannah does not have power of attorney, it would be reasonable to expect to be kept informed.

The other people who will be able to help are the helpline at the Office of the public guardian. They will be able to advise you as to whether the powers conferred under the LPA are being abused.

I echo what SpeedyH has said, do contact the Office of the Public Guardian about this as they monitor those who hold Power of Attorney and can advise.

Also - if Hannah needs emotional support whilst she's going through this, please suggest Sibs (the charity for siblings of people with disabilities). There are online peer support groups for adult siblings here: sibs.org.uk/support-for-adu...

Hello

What a tricky situation.

There is lots of information about POA here - mencaptrust.org.uk/guides-l... but I can see that this doesn't necessarily help with your question.

Our helpline can't give legal advice - but they might be able to suggest where to go for help. Please get in touch on 0808 808 1111, or email helpline@mencap.org

Best wishes

Sarah
