The painful grey area between disabled and non disabled

What is the classification for being disabled? My son is moving from school to college and he needs a scribe to continue his studies. He was turned down for a statement of special needs even though he is diagnosed with Autistic spectrum disorder and dyslexia. Hertfordshire council say that if you are making progress then you do not need an Educational health and support plan. You have to fail in order to even be considered for help. He has no transition plan because of this, and because his school has no contract with Youth Connexions he is left in a

nomansland between being a "normal person" and a disabled person. Disabled seems only to apply to people who have obvious physical disabilities and learning disabled is a term mostly used for people with a low IQ. He is neither but he is very vulnerable and I feel people like him have no classification that applies to them and are therefore overlooked for help.
