huge back log in dla appeals

hi i i sent my claim for dla on 24/04/2012 got refused appealed rang them on 07/03/2013 they said there had been problems with there back log and were implimenting a new system and i would be waiting another 12 to 18 months is this just birmingham area or all centers

Am not surprised if atos work pratice are anything to go by ... Thats what happens when thay use GPs that have lost NHS privlages ... Need a say more or is that one for google.com :O

I got a letter form the courts & tribunals service recently, advising me that it will be 29-33 weeks before they will be able to set a date for my DLA hearing. But, they only gave me 14 days to return the form saying if I still wanted to continue the tribunal process.

I first applied in June last year, they turned me down in August, I appealed at the end of August and was seen by an ATOS doctor in October with a revised decision issued in November. I appealed that and have had the tribunal info at the end of February, it looks like it could be September-ish before the hearing.

Good job I'm not dashing off anywhere in the meantime...

Thats good one for newspapers ... F.O.I request to atos like how many doctors do thay use for dwp medical assements who have lost there NHS Privalged :O

I applied for DLA 02/04/2012 i appealed in july after a reconsideration was turned down and i got my tribunal hearing this thursday 07/03/2013 and im pleased to say i was awarded high rate mobility and low rate care i live in the lancashire area it seems a long time for you to wait and i would seek the help of welfare rights to try and speed it up i know from my own experiance its a long anxious time to wait and to have to wait another 18 months is crazy to say the least i wish everybody good luck with your appeals and advise that before your tribunal date you get as much medical support evidence from your gp and consultants and any one who cares for you . however the tribunal will only want to know and ask questions on how you were and how your health affected you at the time of your appeal mine was last July and all questions that were put to me by the tribunal i had to answer how i was then so its worth making a note of how you were affected at the time of your appeal i hope this helps .

I went to tribural and judge said he was indepemdant ... Thats was not the case thay even judge you as your walking in ... Sent my refused next day ... But reason of statment as taken other a month

I had an ATOS doctor see me after appealing my original DLA decision, he was working to a DWP document to carry out his 'assessment', which was nothing more than him writing down answers to questions he asked me, no verification, a very limited 'examination', useless really.

At my tribunal there was 3 people the judge who is a legal lawyer and is by law nothing to do with dwp there was a doctor and a person from disabled who may be disabled himself are has something to do with disabled people before i went in they read all my evidence and all dwp evidence they asked how i got there i parked outside the front doors as i have a blue badge which i got 2 months ago the doc asked me questions as to my disabilities at time of appeal asked me where i would go when i went out how far it was and how long did it take and how many times i had to stop then asked me questions a bout my personal needs at home and finaly asked about my medical evidence the disabled person asked me about making a meal and washing n bathing the judge explained that she was independent and the procedure they asked the questions would be asked and at the end i could tell them at that point anything i wanted them to know and if you have any one as a witness they can speak at the end as well i was sent out for 5 mins and returned where they gave me a paper and said what they had awarded me i found it ok but i would because i won my appeal but it was nerve racking far from being elated i was shattered felt like i had just come off a mountain .

I am amazed you managed it alone, I think I was fortunate to have welfare rights batting for me.

I jumped through all the hoops, metaphorically of course. What amazes me is the time it took.

First applied middle Nov 2012 refused Dec 2012 appeal set for last week. job done

Looking for all the other goodies that go with Higher rate,new lungs maybe,I was sent to see a ear nose and throat surgeon a little while ago with a throat problem and nearly came away with a new nose, the NHS is not to be sniffed at.Owt for nowt as they say in Yorkshire

so you won your appeal well done it took me 2 weeks short of a year start to finish the tribunal was not as bad as i expected but what helped me was i got as much medical evidence as i could letters from my gp and consultants and other evidence thing is though we have to go through it all again in the next couple of years with pip even though mine was granted indefinatley they are going to give us another medical and from what i hear about atos who do it im not looking forward to that they atos are reported to be sending people to work who are at deaths door its criminal anyway thats later i will face that when it comes you enjoy your freedom wheezie and take care

Hello bobless,

Had a chat at the trib with my welfare rights man and he intimated to me that I would not be up for scrutiny till 2015.I have since had a look into this to check when they will be getting the hoops out for us on the government sites and I was under the impression that as we are before April 8th we will be reviewed in 2015.My man said it was a bit like bringing an Ocean going liner to a halt.

I have noticed that they can move with the speed light when they want to ,and it is in their interests and not ours.so here's hoping.
