Will i able to work again with RA & Advanced Lung Problems.

Mattcass, again i am in the dark on this will i be able to claim somewhere as i only Have CSP for 8 weeks full pay & 8 weeks half pay any advice is apprecciated it is nice to know there is help out there.

Dear Mattcass. Late at night, not many people around. I cant help you myself but there some very knowledgeable and friendly people in this forum. You wont be alone but give it a few hours. You can ring the BLF helpline which is 03000 030 555 also, but that will have to be on Monday.

If you are in work the only benefit you will be able to claim is disability living allowance commonly known as DLA, but this is about to be changed to PIP in April 2013. You will have to have least had the problems (they judge you not on the condition, but how it effects you) for at least 3 months, and your condition is expected to last at least 9 months.

Once you stop receiving pay but still have a job you can apply for Employment Support Allowance, but beware it isn't an easy process, I know that the DWP gets very confused with people claiming this benefit whilst in a job but not receiving sick pay. My mum on two occasions had extended periods off work due to incapacity and put in claims for this benefit, and on both occasions she was close to going to tribunal, but DWP buckled under at the last minute.

In her case they originally decided she was capable of work, which she wasn't because she had plaster up to her hip, couldn't get to her job and was a hospital housekeeper/porter.

If you do go down this road, best to speak to the helpline here first because they will be able to support you better.

In respect of your job, has your doctors told you to rethink your employment? It might be that they think you can manage if you work part time or change your position within the company. Your employer is required by law to make reasonable adjustments. Though also bear in mind, if after they have made reasonable adjustments and your sick record continues to effect your job, they can ask to you resign from your post.

Some companies after an extended period of sick leave will require you to attend a "Fit to Work Interview," or see an occupational doctor who will decide if you have the ability to perform your current job as previously.

Before any of this may/may not happen I think

!: You should discuss your concerns with your doctor, because you really cannot move forward without their input/thoughts.

2. Speak to the likes of BLF they will have a better understanding of legal implications/benefits advice of your situation.
