Hi just looking for info which I probably know :( won my esa appeal waiting on back pay but owe DWP for overpayment will they take backpay

Well it seems the norm for DWP to take back payments if they are owing.

I have never applied for disability or signed on unemployed for more than 2wks soam not well up on the subject but you never know now with having PBC so I find it interesting reading others' experiences.

From myself being one of the unfortunates back in tax yr 2009/2010 who was sent a letter stating I owed DWP taxes from my employments when DWP had new computer systems, they did pursue me regardless of me still saying it was their mistake.

I was owed tax back from 2010/2011 tax year and it ended that they simply took what they stated I owed and handed me the pittance that was left.

I should imagine that any form of disability would be treat slightly different. I seem to think that if the money owed is less than back paid owed you would just be paid that amount but if it isn't then maybe you will get the option to pay back the amount in some form of installments but I suspect the current money you are now entitled will be reduced at a weekly or fortnightly rate until it is paid.

Go to or phone your nearest Citizens Advice Bureau, they are brilliant and cannot help you enough. They know about EVERYTHING!!

You sound like you have had a good experience with the CAB where you are, unfortunately for me the one locally I've never had such luck.

I used them on 2 occasions in the past and the first, got given information that wasn't to my advantage (was when my father passed away) and then I didn't get anywhere when I went in to ask about rights at work when I found myself in a job where I wasn't being paid correctly. I came away with computer print-outs that I had seen myself online on their site! I wasted my day off work in going there too!

In my experience with regards to working and rights, I did find the ACAS site more helpful and also on ringing them up.
